Payment Terms & Conditions

Introduction
These Payment Terms & Conditions ("Payment Terms") govern all payments made to LUXURYWISH ("LUXURYWISH," "we," "us," or "our") in connection with the purchase, reservation, layaway, preorder, sourcing, delivery, or other acquisition of luxury merchandise offered through LUXURYWISH.
Our payment procedures are designed to provide Clients with convenient payment options while maintaining the security and integrity required for high-value luxury transactions.
By making, initiating, authorizing, or arranging any payment to LUXURYWISH, the Client ("Client," "you," or "your") acknowledges that they have read, understood, and agreed to these Payment Terms together with any other LUXURYWISH policies applicable to the transaction.
1. Scope and Application
These Payment Terms apply to payments made in connection with purchases through any authorized LUXURYWISH sales channel, including:
- LUXURYWISH showroom;
- Official website;
- Instagram;
- Viber;
- Private Viewing;
- Live selling;
- Direct sales;
- Layaway;
- Preorder;
- Client-requested sourcing;
- Consignment sales;
- Domestic and international transactions; and
- Other authorized LUXURYWISH channels.
These Payment Terms apply whether payment is made in full, by down payment, installment, reservation payment, partial payment, or another payment arrangement expressly approved by LUXURYWISH.
2. Relationship with Other Luxurywish Policies
These Payment Terms shall be read together with all policies applicable to the transaction, including where relevant:
- Terms & Conditions of Sale;
- Layaway Policy;
- Return, Exchange & Refund Policy;
- Private Viewing Policy;
- Preorder Terms;
- Shipping & Delivery Policy;
- Authentication Guarantee;
- Consignment Terms;
- Privacy Policy; and
- Transaction-specific written terms.
Where another policy specifically governs a particular payment arrangement, that policy shall supplement these Payment Terms. Where transaction-specific written terms expressly differ from these standard Payment Terms, the transaction-specific terms shall apply to that transaction to the extent legally permissible.
3. Accepted Payment Methods
LUXURYWISH may accept payment through one or more of the following methods, subject to availability and approval:
- Cash;
- Philippine bank transfer;
- GCash;
- Approved electronic fund transfer;
- Credit card;
- BDO credit-card installment arrangements;
- PayLink or other approved payment links;
- PayPal, where expressly offered;
- United States Dollars (USD);
- Approved foreign-currency payments;
- Cash on Delivery, where approved;
- Cash on pickup;
- Combination or split-payment arrangements approved in advance; and
- Other payment methods expressly authorized by LUXURYWISH.
The payment methods available may vary according to Item value, transaction amount, Client location, Item category, sales channel, payment-provider limitations, fraud and security considerations, promotional terms, or other operational considerations.
LUXURYWISH reserves the right to restrict or decline a particular payment method for a specific transaction where reasonably necessary.
4. Payment Instructions
Clients must make payments only to:
- Official LUXURYWISH bank accounts;
- Official LUXURYWISH payment links;
- Officially designated payment accounts; or
- Payment details expressly communicated through an authorized LUXURYWISH channel.
The Client is responsible for confirming the payment instructions before transferring funds. LUXURYWISH shall not be responsible for funds voluntarily transferred by a Client to an incorrect or unauthorized account where the incorrect account information was not supplied by LUXURYWISH.
If there is any doubt regarding payment instructions, the Client should verify them with LUXURYWISH before making payment.
5. Availability of Item Before Payment
Unless an Item has already been secured through an expressly approved reservation or layaway arrangement, an inquiry, invoice, Statement of Account ("SOA"), payment instruction, or intention to purchase does not by itself reserve the Item.
LUXURYWISH generally operates on a first-to-pay basis. Accordingly, an Item remains available to other Clients until the payment required to secure the Item has been:
- Successfully made;
- Received by LUXURYWISH;
- Verified; and
- Matched to the correct transaction.
6. First-to-Pay Policy
Where two or more Clients express interest in the same Item, priority shall generally be given to the Client whose required payment is first successfully received and verified by LUXURYWISH, unless another arrangement has already been expressly approved.
The following do not ordinarily secure an Item:
- "Mine" or similar comments;
- Verbal promises;
- Screenshots showing an intended transfer;
- Pending transactions;
- Requests for payment details;
- Statements that the Client is "about to pay";
- Unverified deposit slips;
- Payment attempts that fail;
- Declined card transactions; or
- Other expressions of intent without verified payment.
7. Payment Verification
A payment shall be considered completed only when LUXURYWISH has successfully verified receipt of cleared funds. Submission of a screenshot, bank receipt, deposit slip, transfer confirmation, reference number, card authorization screen, GCash confirmation, PayPal notice, payment-link acknowledgment, or similar documentation does not by itself constitute final payment verification.
LUXURYWISH may verify payment directly through its banking, payment, accounting, or merchant records before marking a transaction as paid.
8. Pending or Delayed Payments
Payments may occasionally remain pending because of bank processing, interbank delays, payment-provider review, network interruption, card authorization, compliance screening, fraud review, international transfer processing, holiday or weekend banking schedules, or other circumstances outside LUXURYWISH's immediate control.
Until funds have been successfully received and verified, the payment shall remain pending. Unless LUXURYWISH expressly agrees otherwise, a pending payment does not constitute completed payment.
9. Bank Transfers
Clients paying by bank transfer are responsible for:
- Using the correct account details;
- Entering the correct amount;
- Providing the correct payment reference where requested;
- Checking applicable transfer limits;
- Ensuring sufficient available funds;
- Paying applicable sending-bank fees; and
- Retaining proof of transfer until verification.
Where the transfer amount received is less than the amount due because of bank fees or deductions, the Client remains responsible for settling the shortfall.
10. Bank Deposits
Where cash or check deposit into an approved LUXURYWISH bank account is permitted, the transaction shall only be considered paid after the deposit has been identified and cleared.
Any unidentified deposit may remain uncredited until the Client provides sufficient information for LUXURYWISH to match the deposit to the correct transaction.
11. GCash and Electronic Wallets
Payments through GCash or another approved electronic wallet are subject to provider transaction limits, account limits, service availability, processing rules, identity or verification requirements, and applicable provider fees.
The Client is responsible for confirming the recipient information before sending payment. A transaction shall not be considered completed until the amount has been received and verified by LUXURYWISH.
12. Cash Payments
Where cash payment is permitted, including at the showroom, upon approved pickup, or during an approved Private Viewing or Cash on Delivery transaction, the Client must tender the complete agreed amount.
Cash shall be counted, verified, checked for completeness, and recorded by LUXURYWISH before the Item is released. For high-value cash transactions, LUXURYWISH may require reasonable identity verification or additional security procedures.
13. Cash on Delivery
Cash on Delivery ("COD") is available only where expressly approved by LUXURYWISH. Approval may depend on Item value, location, Client history, security, staff availability, delivery arrangements, and other operational considerations.
COD approval for one transaction does not automatically entitle the Client to COD for another transaction. The Client must prepare the agreed payment before the Item is released.
14. Credit Card Payments
LUXURYWISH may accept credit-card payments through approved merchant facilities or payment providers. Credit-card transactions are subject to card issuer approval, merchant-provider approval, available credit limit, fraud screening, identity verification, applicable fees, installment eligibility, and other rules imposed by the card issuer or payment provider.
A card transaction is not considered completed merely because a card has been presented or entered. Final payment remains subject to successful authorization, capture, verification, and settlement.
15. Credit Card Installments
Where available and approved, eligible Clients may use BDO credit-card installment arrangements of approximately three (3) to thirty-six (36) months, subject to the options available for the specific transaction and the rules of the issuing bank or merchant provider.
Available installment periods may vary. LUXURYWISH does not guarantee that every card, bank, transaction amount, or Item will qualify for every advertised installment period.
16. Credit Card Fees and Installment Charges
Where applicable, credit-card processing charges, installment charges, merchant fees, bank interest, or other financing-related charges may be incorporated into or added to the payable amount.
Any material additional charge imposed directly by LUXURYWISH shall be disclosed before payment where required. Fees separately imposed by the Client's card issuer or financial institution remain governed by the Client's agreement with that institution.
17. Cardholder Authorization
The person using a credit card represents that they are the lawful cardholder or are properly authorized to use the card.
LUXURYWISH may require reasonable verification, including valid identification, name confirmation, billing information, signature, cardholder authorization, or other fraud-prevention information. LUXURYWISH may decline or hold a transaction where payment authorization cannot reasonably be verified.
18. Third-Party Card Payments
Where payment is made using a credit card belonging to another person, LUXURYWISH may require additional authorization from the cardholder.
The use of another person's card without proper consent is strictly prohibited. LUXURYWISH may cancel or suspend a transaction where unauthorized card use is reasonably suspected.
19. Split or Multiple Card Payments
Where supported by LUXURYWISH's payment facilities, payment may be divided between multiple cards or payment methods only with prior approval.
LUXURYWISH may limit the number of cards, number of payment channels, amount allocated to each method, or combination of payment types for operational or fraud-prevention purposes.
20. Payment Links / PayLink
Where LUXURYWISH issues a PayLink or another payment link, the link is intended only for the transaction and Client for which it was issued unless otherwise stated. Clients must verify:
- Transaction amount;
- Merchant details;
- Payment method;
- Installment selection, where applicable; and
- Other information displayed before completing payment.
A payment link may expire, become unavailable, or be cancelled. Issuance of a payment link does not by itself reserve an Item unless expressly stated.
21. PayPal
Where PayPal is expressly approved for a transaction, the Client must use the payment type and instructions specified by LUXURYWISH. The Client is responsible for correct recipient information, applicable PayPal charges, foreign-exchange charges, payment limitations, verification requirements, and compliance with the terms of the payment provider.
LUXURYWISH may require additional verification before accepting a PayPal-funded transaction. Nothing in these Terms requires a Client to use a payment classification inconsistent with applicable payment-provider rules.
22. Payments in United States Dollars
LUXURYWISH may accept payment in United States Dollars (USD) for approved transactions. Where a price is originally quoted in Philippine Pesos and the Client elects to pay in USD, the applicable conversion rate shall be the exchange rate expressly confirmed by LUXURYWISH for that transaction.
The applicable rate may differ from Google exchange rates, published interbank rates, credit-card rates, money-changer rates, or rates available through another financial institution. The confirmed transaction rate shall govern once accepted by the Client.
23. Other Foreign Currency Payments
Foreign currency other than USD may be accepted only by prior agreement. LUXURYWISH reserves the right to:
- Decline a foreign currency;
- Determine the applicable transaction rate;
- Require conversion to PHP or USD;
- Require payment through an approved bank; or
- Require the Client to bear applicable conversion and transfer costs.
24. Foreign Exchange Fluctuations
Where a transaction has not yet been secured, currency quotations may be subject to change due to foreign-exchange movement. Once payment has been made and the transaction properly confirmed, the agreed transaction amount shall govern subject to any remaining balance under the applicable agreement.
A Client is not entitled to a refund or price adjustment solely because exchange rates later move in the Client's favor.
25. International Bank Transfers
Clients making international transfers are responsible for ensuring that LUXURYWISH receives the full amount due. The Client is responsible for applicable sending-bank fees, correspondent-bank fees, intermediary-bank deductions, foreign exchange charges, and other transfer expenses unless expressly agreed otherwise.
If the amount ultimately received is less than the required amount, the Client must settle the difference before the transaction is considered fully paid.
26. Payment in Another Person's Name
Where payment originates from an account belonging to someone other than the purchasing Client, LUXURYWISH may require information reasonably necessary to identify and verify the payer. This may include name of payer, relationship to Client, proof of transfer, confirmation of authorization, or identification where reasonably necessary.
LUXURYWISH may delay release while a third-party payment is being verified.
27. Corporate or Business Payments
Where a purchase is paid from a corporate or business account, the Client may be required to provide information sufficient to identify the paying entity, authorized representative, transaction purpose, and relationship between payer and purchaser.
Additional requirements may apply to high-value corporate transactions.
28. Partial Payments
Partial payment does not automatically reserve an Item unless it forms part of an expressly approved layaway, reservation, preorder, special payment arrangement, or other written agreement.
Sending an amount lower than the required securing payment without prior approval does not obligate LUXURYWISH to hold the Item.
29. Down Payments
Where an approved transaction requires a down payment, the specific percentage, amount, refundability, payment schedule, and consequences of non-payment shall be governed by the applicable transaction terms.
For standard LUXURYWISH Layaway arrangements, the applicable provisions are contained in the separate LUXURYWISH Layaway Policy & Terms and Conditions.
30. Layaway Payments
Layaway payments must be made according to the approved schedule and are subject to these Payment Terms, the LUXURYWISH Layaway Policy, the confirmed final due date, and any transaction-specific written terms.
Where there is a conflict concerning a layaway-specific payment obligation, the Layaway Policy shall govern that issue.
31. Preorder Payments
Preorders may require full payment, down payment, reservation payment, or another amount expressly communicated at the time of order.
Because preorder Items may be purchased or sourced specifically for the Client, preorder payments may be subject to separate cancellation and refund rules. The Client should review the applicable preorder terms before making payment.
32. Client-Requested Sourcing
Where LUXURYWISH is requested to procure a specific Item for a Client, payment may be required before sourcing or acquisition.
Once LUXURYWISH has materially relied upon the Client's confirmed order and committed funds to acquire the requested Item, cancellation may be restricted subject to applicable law and the transaction-specific terms.
33. Consigned Items
Payments made for consigned merchandise are payable to LUXURYWISH through the payment method authorized for the transaction unless otherwise expressly instructed.
The Client shall not directly pay a consignor unless LUXURYWISH has expressly authorized such arrangement in writing. A payment made directly to an unauthorized third party does not automatically discharge the Client's payment obligation to LUXURYWISH.
34. Prices
All prices are stated in the currency identified in the applicable listing, invoice, SOA, quotation, or transaction confirmation. Unless expressly stated otherwise, the Client must pay the full confirmed purchase price together with any applicable charges.
35. Price Changes Before Payment
Luxury resale prices may change based on market demand, supplier cost, consignor instruction, currency movement, brand retail price movement, availability, promotion, or other commercial factors.
Until an Item has been properly secured, LUXURYWISH may revise the listed or quoted price. Once an Item has been secured under an accepted transaction, the confirmed price shall generally apply subject to the terms of that transaction.
36. Typographical or Pricing Errors
LUXURYWISH may correct an obvious typographical, computational, system, or pricing error where a displayed price is clearly inconsistent with the intended transaction or commercially unreasonable under the circumstances.
Where payment has already been made based on a genuine material pricing error, LUXURYWISH may cancel the affected transaction and return the amount received, subject to applicable law. LUXURYWISH will not be required to complete a transaction at an obviously erroneous price where applicable law permits cancellation.
37. Discounts and Promotional Pricing
Promotional prices apply only during the stated promotional period and subject to the applicable promotional conditions. Unless expressly stated otherwise:
- Discounts cannot be combined;
- A later promotion does not retroactively reduce an earlier completed purchase;
- Promotional prices may apply only to selected payment methods;
- Some installment arrangements may have different pricing; and
- Promotional privileges may be withdrawn where payment is not completed within the required period.
38. Overpayment
Where LUXURYWISH receives an amount exceeding the confirmed amount due, the overpayment shall be reviewed and verified. Subject to verification, LUXURYWISH may return the excess amount, apply it toward another amount owed with Client approval, or resolve it through another mutually agreed arrangement.
LUXURYWISH may require reasonable verification before refunding an overpayment.
39. Underpayment
Where the amount received is less than the amount due, the transaction remains partially unpaid. The Client must settle the outstanding difference before the Item may be considered fully paid or released.
An underpayment caused by bank fees, exchange-rate deductions, payment-provider charges, input error, or other payment deductions remains the Client's responsibility unless otherwise agreed.
40. Duplicate Payment
Where the Client reasonably believes that the same transaction has been charged or transferred more than once, the Client should immediately notify LUXURYWISH. Upon verification of a duplicate receipt, LUXURYWISH shall arrange an appropriate reversal or refund of the duplicate amount.
41. Payment Errors
Clients must immediately notify LUXURYWISH of any known payment error. LUXURYWISH may correct accounting or allocation errors where supported by transaction records.
No Client shall knowingly retain the benefit of an erroneous refund, duplicate credit, reversal, or other payment error.
42. Payment Receipts and Records
LUXURYWISH may maintain SOAs, official receipts or invoices as applicable, payment screenshots, bank confirmations, transaction references, merchant records, internal payment verification records, and Client communications for accounting, security, fraud prevention, dispute resolution, and legal compliance.
Clients should retain their payment records until the transaction is completed.
43. Statement of Account
A Statement of Account or payment summary issued by LUXURYWISH may identify the Client, Item, purchase price, payment received, remaining balance, due date, payment arrangement, applicable charges, and other transaction information.
Clients should promptly report any apparent discrepancy. An obvious clerical error in an SOA does not prevent LUXURYWISH from correcting the account based on verified transaction records.
44. Payment Does Not Automatically Mean Immediate Release
Successful payment does not necessarily mean the Item can be physically released immediately. Before release, LUXURYWISH may still be required to complete:
- Payment verification;
- Authentication clearance;
- Quality control;
- Inventory verification;
- Condition checking;
- Preparation of confirmed inclusions;
- Documentation;
- Packing; or
- Fulfillment processing.
45. Ownership and Release
Unless otherwise required by law or expressly agreed, possession and control of an Item shall remain with LUXURYWISH until the amount required for release has been fully paid and verified.
An Item shall not be released solely because a screenshot has been presented, a transfer is pending, a substantial percentage has been paid, a credit-card authorization is awaiting settlement, or the Client promises to settle the remaining amount later.
46. No Partial Release
Where an Item remains unpaid, LUXURYWISH has no obligation to release the Item, box, dust bag, strap, lock or keys, clochette, authentication certificate, receipt, accessory, complimentary inclusion, or any other component forming part of the sale.
47. Fraud Prevention
Because LUXURYWISH handles high-value transactions, payments may be subject to fraud-prevention procedures. LUXURYWISH may reasonably request:
- Identification;
- Cardholder confirmation;
- Bank account confirmation;
- Proof of payment;
- Source-of-payment clarification;
- Additional payment-provider verification; or
- Other information necessary to protect the transaction.
A request for reasonable verification does not constitute an accusation of wrongdoing.
48. Suspicious Payment Activity
LUXURYWISH may suspend, delay, decline, or cancel a transaction where there is a reasonable concern involving:
- Unauthorized payment;
- Stolen payment credentials;
- Fraudulent transfer;
- Altered payment receipt;
- Falsified screenshot;
- Identity misrepresentation;
- Payment laundering;
- Suspicious third-party funding;
- Repeated failed transactions;
- Chargeback abuse; or
- Other potentially unlawful activity.
Where appropriate, LUXURYWISH may preserve records and cooperate with financial institutions or competent authorities.
49. Payment Reversals
A payment initially credited to a transaction may later be reversed because of bank reversal, chargeback, payment-provider dispute, unauthorized-payment claim, returned transfer, fraud investigation, card reversal, or other financial-provider action.
A reversed payment shall no longer be treated as valid payment. The Client remains responsible for any valid amount lawfully due under the transaction.
50. Chargebacks
A Client who has a genuine concern regarding a transaction is encouraged to contact LUXURYWISH directly so the matter can be properly investigated.
A chargeback must not be used to obtain both:
- Retention of the purchased Item; and
- Reversal of the corresponding purchase funds.
Where a chargeback or payment dispute is initiated, LUXURYWISH may submit legitimate evidence to the relevant bank or payment provider, including transaction records, payment authorization, Client communications, SOA or invoice, Item photographs, authentication records, Private Viewing records, shipping records, delivery confirmation, proof of collection, and other relevant evidence.
51. Unauthorized Payment Claims
Where a Client or payment account holder claims that a payment was unauthorized, LUXURYWISH may suspend Item release, shipping, refund processing, consignor settlement, or other related transaction activity while the claim is investigated.
The Item may remain under LUXURYWISH custody until the payment issue has been reasonably resolved.
52. Refunds
Any refund is subject to the separate LUXURYWISH Return, Exchange & Refund Policy, together with applicable law. Making payment does not create an unconditional right to cancellation or refund. Refund eligibility depends on the circumstances giving rise to the refund request.
53. Refund Method
Where a refund has been approved, LUXURYWISH will ordinarily return funds through the original payment method where practicable, bank transfer to the verified purchaser, payment-provider reversal, or another method mutually agreed and reasonably secure.
LUXURYWISH may require reasonable identity or account verification before releasing a refund.
54. Refund to Third Party
For fraud-prevention purposes, approved refunds will generally be returned to the original payer or verified purchasing Client. LUXURYWISH may decline a request to send a refund to an unrelated third-party account unless a valid and sufficiently documented reason exists.
55. Payment-Provider Processing Times
Once LUXURYWISH has initiated an approved refund, reversal, or settlement, the actual posting time may depend on the bank, card issuer, PayPal, electronic wallet, merchant provider, international banking network, or other financial institution.
LUXURYWISH does not control processing times imposed by third-party financial institutions.
56. Non-Refundable Third-Party Charges
Where permitted by applicable law, fees separately charged by third parties — including certain bank charges, international transfer fees, foreign-exchange charges, credit-card issuer charges, financing charges, or other external provider fees — may not be refundable by LUXURYWISH because they were not retained by LUXURYWISH.
Where LUXURYWISH is legally responsible for such a cost, the applicable legal requirement shall prevail.
57. Cancellation After Payment
A Client's request to cancel after payment is governed by the nature of the transaction, whether the Item has already been reserved or sourced, layaway terms, preorder terms, the Return & Refund Policy, applicable statutory rights, and any transaction-specific agreement.
Payment should therefore be made only after the Client has carefully reviewed the Item and applicable terms.
58. Change of Mind
Payment is considered a commitment to proceed with the transaction. A Client is not automatically entitled to a refund solely because they:
- Changed their mind;
- Found another Item;
- Found a lower price elsewhere;
- Changed preference;
- No longer require the Item;
- Experienced a change in financial circumstances; or
- Regret the purchase.
Any remedy remains subject to the applicable Return & Refund, Layaway, Preorder, or other transaction terms and applicable law.
59. Payment Deadlines
Where a payment deadline applies, the Client is responsible for making payment sufficiently early for it to be received within the required period.
A transfer initiated before a deadline but received only after the deadline may be treated according to the specific transaction terms and circumstances.
60. Client Responsibility for Payment Details
The Client is responsible for ensuring that all information supplied in connection with payment is accurate, including name, contact information, Item reference, payment amount, bank reference, cardholder information, shipping information, and other required transaction details.
Delays arising solely from incomplete or inaccurate information provided by the Client do not automatically extend a reservation or payment deadline.
61. Communications
LUXURYWISH may contact the Client regarding payment instructions, verification, remaining balance, payment deadlines, failed transactions, security checks, refunds, chargebacks, fulfillment, or other payment-related matters.
Clients are responsible for maintaining active and accurate contact information.
62. Payment Reminders
Where a scheduled payment is required, LUXURYWISH may provide reminders as a courtesy. The absence of a reminder does not cancel the payment obligation, extend the due date, waive a late fee, prevent default, or amend an agreed payment schedule.
63. Client Data and Payment Security
LUXURYWISH may collect and process payment-related information reasonably necessary to:
- Complete transactions;
- Verify payments;
- Prevent fraud;
- Maintain financial records;
- Process refunds;
- Handle disputes;
- Comply with legal obligations; and
- Protect Clients and the business.
Payment information shall be handled according to applicable privacy and security requirements and the LUXURYWISH Privacy Policy.
64. Third-Party Payment Providers
Certain payment methods are processed by banks, card networks, electronic-wallet providers, payment gateways, PayPal, or other third-party financial institutions. Those services may be subject to separate terms between the Client and the provider.
LUXURYWISH is not responsible for a provider's independent service outage, account restriction, credit decision, card decline, financing decision, currency conversion, processing delay, or internal policy, except to the extent responsibility is imposed on LUXURYWISH by applicable law.
65. Technical Failures
A failed or interrupted payment attempt does not constitute payment. Where a Client experiences a technical issue, the Client should verify whether funds were actually debited before attempting a duplicate payment. LUXURYWISH will reasonably assist in verifying whether payment was received.
66. Compliance with Law
LUXURYWISH may decline, hold, report, refund, or otherwise take reasonable action regarding a payment where necessary to comply with applicable law, court order, regulatory requirement, banking requirement, fraud-prevention obligation, or other legal process.
Nothing in these Payment Terms requires LUXURYWISH to process a payment or transaction in violation of applicable law.
67. Force Majeure and Banking Disruption
LUXURYWISH shall not be considered in breach solely because of a payment-processing delay caused by circumstances reasonably beyond its control, including banking outages, payment-system failures, internet disruption, natural disasters, severe weather, government restrictions, civil disturbance, cybersecurity incidents, financial-network interruption, or other comparable events.
Where appropriate, LUXURYWISH will use reasonable efforts to verify and resolve the affected transaction.
68. Limitation of Liability
To the extent permitted by applicable law, LUXURYWISH shall not be liable for indirect, incidental, special, exemplary, or consequential loss arising solely from the operation or failure of a third-party bank or payment provider. Nothing in these Payment Terms excludes liability that cannot lawfully be excluded or limited.
69. No Waiver
Failure or delay by LUXURYWISH in enforcing any payment requirement, deadline, verification requirement, or other provision shall not constitute a permanent waiver of that requirement. An exception granted in one transaction does not create an entitlement to the same exception in another transaction.
70. Severability
If any provision of these Payment Terms is determined by a competent authority to be invalid or unenforceable, the provision shall be limited or severed only to the extent necessary. The remaining provisions shall continue in force to the fullest extent permitted by law.
71. Amendments
LUXURYWISH may revise these Payment Terms from time to time to reflect changes in payment methods, banking arrangements, merchant providers, business operations, security requirements, or applicable law.
Unless otherwise required by law, the payment terms applicable to a confirmed transaction shall be those in effect or expressly communicated when the relevant payment arrangement was entered into.
72. Governing Law
These Payment Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Nothing in these Terms shall exclude, restrict, or waive any right or remedy that cannot legally be excluded, restricted, or waived.
73. Client Acknowledgment
By making or authorizing payment to LUXURYWISH, the Client acknowledges and agrees that:
- Payment must be made only through an authorized LUXURYWISH payment channel;
- An Item is generally subject to a first-to-pay policy until the required payment has been received and verified;
- A screenshot, pending transfer, payment reference, or other proof does not by itself constitute verified payment;
- The Client is responsible for ensuring that the correct payment details and amount are used;
- Applicable banking, card, payment-provider, installment, currency-conversion, and transfer charges may apply;
- International and foreign-currency payments must result in LUXURYWISH receiving the full amount required for the transaction;
- Third-party or cardholder payments may be subject to additional verification;
- LUXURYWISH may reasonably delay release while payment, identity, authorization, fraud, or security concerns are being verified;
- No Item shall be released until the amount required for release has been fully received and verified;
- Partial payment does not automatically reserve an Item unless expressly approved;
- Layaway, preorder, sourcing, and other special payment arrangements remain subject to their respective policies;
- A payment reversal or chargeback may result in suspension of the transaction and investigation;
- Refund eligibility is governed by the applicable LUXURYWISH Return, Exchange & Refund Policy and applicable law;
- Change of mind alone does not automatically create a right to refund;
- The Client is responsible for maintaining accurate transaction and contact information; and
- The Client has read, understood, and voluntarily agrees to these Payment Terms.
